These terms govern your use of mattderman.com and its newsletters, downloads, educational material, and other public resources. The site is operated by Friday Studios (Pty) Ltd trading as MattDerman.com ("MattDerman.com", "we", "us", or "our") in Cape Town, South Africa.

By using the site, you agree to these terms. If you do not agree, do not use the site. You must be at least 18 years old, or have the involvement and permission of a parent or legal guardian, to submit a form or buy a service.

What the site provides

MattDerman.com shares writing, newsletters, downloads, software and business education, examples, and information about free or paid services. Public material is general information, not legal, financial, tax, investment, medical, or other regulated professional advice.

Features and material may change, be corrected, or be withdrawn at any time. We do not promise that every resource will remain available.

Newsletters and downloads

When you ask for a newsletter or download, you agree that we may send the requested material and related messages described beside the form. Some subscriptions use double opt-in and only become active after you confirm your email. You can unsubscribe from marketing email at any time.

You are responsible for providing accurate contact information and keeping access links or downloaded material secure.

Free and paid services

Website forms and public pages do not, by themselves, create a consulting, employment, partnership, agency, or other professional relationship. Any paid service may be subject to a proposal, statement of work, order form, or other written agreement. If that agreement conflicts with these website terms, the signed agreement governs the paid service.

Earnings, results, and testimonials

Results described on this site are not typical, promised, or guaranteed. Skills, experience, motivation, decisions, time, effort, market conditions, timing, resources, and other known or unknown circumstances affect every outcome. We have not performed a study establishing the results of a typical reader, subscriber, or client unless a specific statement says otherwise.

MattDerman.com provides education and support. We do not sell a business opportunity, a get-rich-quick program, or a money-making system. We make no earnings claim or effort-based guarantee, and participating in a course, service, or training does not guarantee revenue, profit, sales, career progress, or any other financial or business result.

Testimonials and customer stories describe individual opinions or experiences. They do not promise that another person will obtain the same result. When a story is an illustrative composite based on real experiences, it will be clearly identified as a composite and does not represent an actual individual. You should evaluate all claims independently and make decisions suited to your own circumstances.

Intellectual property and permitted use

The site and its original text, designs, code, images, videos, audio, downloads, branding, and other material are owned by or licensed to Friday Studios (Pty) Ltd and are protected by intellectual property law.

Unless a resource includes a different licence, we give you a limited, revocable, non-exclusive, non-transferable right to access the site and use downloaded educational material for your own personal or internal business learning. You may not reproduce, resell, publish, distribute, scrape, create a competing resource from, or commercially exploit the material without written permission.

Product names, logos, quotations, and material belonging to third parties remain the property of their respective owners.

Acceptable use

You may not:

  • Break the law or infringe another person's rights through the site.
  • Interfere with the site's operation, security, access controls, or other users.
  • Introduce malicious code, probe for vulnerabilities without permission, or attempt unauthorised access.
  • Use automated systems to extract substantial parts of the site or overload it.
  • Impersonate another person, submit misleading information, or use a form to send spam or abusive content.

We may restrict access where reasonably necessary to protect the site, its users, or our rights.

Messages, feedback, and testimonials

You retain ownership of material you send us. You give us permission to use it as needed to respond, deliver a requested service, and protect or operate the site. We will only publish a testimonial, attributed quote, case study, or identifying client material with appropriate permission. Separate written permissions may set additional terms.

Do not submit material you do not have the right to share.

The site may link to third-party sites, software, tools, payment services, or social platforms. We do not control them and do not endorse or guarantee their content, availability, security, or practices. Their terms apply to your use of them.

Disclaimers

To the fullest extent permitted by law, the site and public material are provided "as is" and "as available". We do not warrant that they will be uninterrupted, error-free, complete, current, secure, or suitable for a particular purpose. Nothing in these terms excludes a warranty or consumer right that applicable law does not allow us to exclude.

Limitation of liability

To the fullest extent permitted by law, Friday Studios (Pty) Ltd and its directors, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for lost profit, revenue, data, opportunity, or goodwill arising from the site or public material.

For any other claim arising only from the site or public material, our total liability will not exceed the amount you paid us for the specific affected website product or service during the 12 months before the event giving rise to the claim. If you paid nothing, that cap is zero. These limits do not apply where liability cannot lawfully be excluded or limited. A separate signed client agreement may contain different limits for paid work.

Changes and termination

We may update these terms by publishing a revised version and changing the date above. Changes apply from publication unless stated otherwise. We may suspend or end access to all or part of the site where reasonably necessary.

Governing law

These terms are governed by the laws of South Africa. Courts with jurisdiction in South Africa may hear disputes, subject to any mandatory consumer or other legal rights that apply.

If one part of these terms is unenforceable, the remaining parts continue to apply. A failure to enforce a term is not a waiver of it.
